STATE SUPREME COURT RULES AGAINST TAXING ENTITIES

  Parker County Commissioners Court were told at their Monday, May 14 regular meeting, that a State Supreme Court ruling would lead to the county having to pay back over $600,000 in taxes.

   Parker County Appraisal District Chief Appraiser Larry Hammonds shared the news citing approximately 200 gas compressors in Parker County valued close to $35 million for each of the past six years.

   The landmark case is titled EXLP Leasing, LLC and EES Leasing, LLC v. Galveston Central Appraisal District, No. 15-0683.

   Parker County had joined 86 other counties, led by Galveston County, in a law suit that was originally filed in 2012 over the classification of gas compressors as heavy equipment and where the correct taxable location for the equipment to be taxed in is.

   Galveston County argued the compressors should not be classified as heavy equipment and the trial court agreed with them. The compressor companies argued against and appealed.

   The appellate court also agreed with Galveston and the other counties, but the compressor companies took the case all the way to the State Supreme Court who ruled in favor of the compressor companies.

   “Our attorney has advised that Galveston County will request a re-hearing, but the chances are slim that the Supreme Court will grant their motion,” Hammonds said. “We presume we will be approached in the next three to six months by the compressor companies and their counsel to settle the outstanding cases and draw up agreed judgments. I am sharing this information with you now because sometime in the future, we will be asking each taxing entity involved to prepare refund checks to satisfy the judgments.”  

   County Judge Mark Riley said Parker County faces losses of $498,393.15 from the general fund and $124,185.73 from the lateral road and bridge fund.

   Aledo ISD faces the largest possible refund of their tax dollars with a total of $1,200,357. The costs to the other entities in Parker County are located in the table below.
